The law
Let’s start with what the law says about high hedges. You might be surprised to know that there wasn’t actually a definition of a high hedge until 2003. The hedge needs to be more than 2m tall and made up of a line of two or more trees or shrubs. The hedge needs to be entirely or predominantly formed of evergreens or semi-evergreen plants, and bamboo and ivy are not included.
There are lots of additional exceptions to the above, which is why it is always essential to work with a team who know the law well. We have been cutting and maintaining hedges for many years, and we will know what can and cannot be done with one that we are called in to deal with.
Grounds for complaints
There are several ways in which a hedge can interfere with a person’s enjoyment of their property. It could block too much light or impede a view. Neither of these is protected by law, but if they are supported with other evidence, they could give someone a case. Another ground for complaint is if a hedge is on a slope, making it much more overbearing. No two cases are the same.
How to complain about a high hedge
If you have an issue with a hedge, the best thing to do is talk to the property owner first. So many people are happy to cut their hedge back; they simply weren’t aware that it was causing an issue. If you are a home or business owner dealing with a complaint from a neighbour, do try to see things from their point of view. From there, there’s every chance you can find a middle ground.
Taking it further
If you can’t reach an agreement with your neighbour, then you need to get in touch with your local council to enquire about using the high hedges legislation. There is a fee for this. Then the council will consider all the evidence and then make a decision, which will either be a rejection of the complaint or the issuing of a notice for the work. This can be appealed.
